1. Acceptance of Terms

By accessing or using Freqium ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Freqium is a web-based wellness platform that delivers therapeutic audio frequencies based on published scientific research. The Service includes frequency playback, AI-powered recommendations, structured wellness protocols, and session tracking.

3. Medical Disclaimer

Freqium is NOT a medical device and is NOT intended to diagnose, treat, cure, or prevent any disease or medical condition.

The frequencies and protocols provided are based on published research but have not been evaluated by the FDA or equivalent regulatory bodies. The Service is intended for general wellness purposes only.

Always consult a qualified healthcare provider before using frequency therapy, especially if you have epilepsy, seizure disorders, are pregnant, have a pacemaker or other implanted medical device, or are taking medication.

Do not use Freqium as a substitute for professional medical advice, diagnosis, or treatment.

4. Account & Eligibility

You must be at least 13 years old to create an account. You are responsible for maintaining the security of your account credentials and for all activity under your account.

5. Subscriptions & Payments

Free Tier: Access to 2 frequencies with 5-minute session limits.

Paid Plans: Monthly and annual subscription options unlock all frequencies, unlimited session time, AI recommendations, and advanced features.

• Payments are processed securely by Lemon Squeezy
• Subscriptions renew automatically unless cancelled before the renewal date
• You may cancel at any time through your account dashboard or customer portal
• Refund requests within 30 days of purchase will be honored
• Free trials (when offered) require a valid payment method; you will be charged at the end of the trial unless cancelled

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract the audio generation algorithms
• Share your account credentials with others
• Use automated tools to access the Service (bots, scrapers, etc.)
• Redistribute, resell, or commercially exploit the frequency content
• Misrepresent frequency therapy results to others as medical treatment

7. Intellectual Property

All content, code, frequency protocols, AI models, and branding are the property of Freqium. Scientific research cited within the app belongs to the respective authors and publishers. You may not reproduce or distribute our content without written permission.

8. Audio Safety

Freqium includes safety features such as automatic fade-in/fade-out and emergency stop (Escape key). However, you are responsible for:

• Listening at a comfortable volume
• Not using the Service while driving or operating machinery
• Stopping immediately if you experience discomfort, dizziness, or any adverse reaction
• Following the recommended session durations

9. Limitation of Liability

Freqium is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the Service, including but not limited to health effects, data loss, or service interruptions. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account for violation of these terms. You may delete your account at any time by contacting support@freqtherapy.com.

11. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify you of material changes via email.
